Peru Regulatory Approval

Type Approval in Peru

In Peru, MTC approval refers to the authorization granted by the Ministry of Transport and Communications (Ministerio de Transportes y Comunicaciones, MTC). The MTC is the government body responsible for regulating the transport and communications sectors in Peru, including telecommunications, broadcasting, and postal services. The MTC's role includes overseeing the deployment and operation of various services, networks, and equipment within the country. Therefore, MTC approval is required for activities related to:

Telecommunications Licenses

Frequency Spectrum Allocation

Any company or entity seeking to provide telecommunications

services (e.g., mobile, internet, satellite communications) in Peru must obtain the necessary licenses and authorizations from the MTC.

For businesses involved in wireless communication, radio, or

television broadcasting, MTC approval is required to use specific frequencies or spectrum bands. This ensures the proper management and non-interference of radio signals within the country.

Importation of Telecommunications Equipment

Broadcasting Licenses

Businesses involved in the construction of telecommunications networks (e.g., fiber optics, cellular towers, data centers) must seek approval from the MTC to ensure compliance with local regulations and to meet safety and environmental standards.

Entities wishing to operate radio or television stations must obtain MTC approval and licenses for broadcasting.

Telecommunication Infrastructure Projects

Consumer Protection and Quality of Service

Businesses involved in the construction of telecommunications networks (e.g., fiber optics, cellular towers, data centers) must seek approval from the MTC to ensure compliance with local regulations and to meet safety and environmental standards.

The MTC is also involved in approving consumer protection measures and ensuring that telecommunications providers meet minimum standards for service quality, reliability, and accessibility.

!

Regulatory Updates For Peru

May 2024

Starting April 22, 2024 , the cellular equipment market will be divided into two lists: one of valid cell phones (white list) and one of blocked cell phones (black list) as a measure to help discourage the theft of cellular equipment.

June 2023

The Ministerio de Transporte y Comunicaciones (MTC) has approved the updated National Frequency Allocation Plan (NFAP), aiming to improve WLAN connectivity and support the development of mobile technologies such as LTE and 5G.

July 2020

MTC in Peru is now enforcing the requirement to obtain updated approvals for cellular products with IMEI numbers previously approved by MTC without consideration of the GSMA registration and TAC. The updated approval must include the GSMA registration as a mandatory requirement, and each TAC requires separate MTC approval.

June 2020

The MTC made some changes to the Specific Regulation of Homologation of Telecommunications Equipment and Apparatus, approved by Supreme Decree No. 001-2006-MTC. Two Supreme Decrees were issued that modify it (see attachments): D.S. N ° 019-2019-MTC (June 2019), and the D.S. N ° 038-2019-MTC (December 2019). You can check more details in our publication: https://c-teitel.com/new-conditions-cell-phone-peru/

D.S. N ° 038-2019-MTC delimits the scope of the exigency of equipment approval requirements, referring to the functionality of Cell Broadcasting Service (CBS) and the presentation of the copy of the certificate or document that records the specific absorption rate (SAR); and, details are made regarding the application of exceptions to obtaining the definitive internment permit, as well as the validity and cancellation of approval certificates issued prior to DS N ° 019-2019-MTC. The list was not released on April 5, 2020 due to COVID-19 quarantine, so it was released on June 24, 2020.

March 2020

All products using cellular technologies that operate above 2.2 GHz (with an output power greater than 50mW) require SAR reports and a GSMA TAC letter as of April 20
